Cardihaler App Terms of Service

These Terms of Service (“Terms”) govern your use of the Cardihaler mobile application(“App”), provided by Conscious Breathing Institute AB (“we”, “us”, “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, you must not use the App.
1. Purpose of the App
The Cardihaler App is provided solely to enable firmware updates for compatible Cardihaler devices. The App does not provide medical advice, diagnosis, monitoring, or treatment and must not be used as a substitute for professional medical advice.
2. Eligibility
You must be at least 13 years of age to use the App. The App is not intended for use by children under the age of 13.
3. Use of the App
You agree to use the App only:
- With compatible Cardihaler devices,
- For its intended purpose of performing firmware updates,
- In compliance with applicable laws and regulations.
You are responsible for ensuring that your device has sufficient battery power, stable connectivity, and meets any applicable requirements before initiating a firmware update.
You must not misuse the App, interfere with its operation, or attempt to access it in an unauthorized manner.
4. Firmware Updates
The App enables over-the-air (OTA) firmware updates. You acknowledge and agree that:
- Firmware updates may fail, be interrupted, or not complete successfully due to factors beyond our control (including connectivity issues, power loss, or device conditions).
- We do not guarantee that firmware updates will always be available, uninterrupted, or error-free.
- You are responsible for initiating updates and for ensuring appropriate conditions during the update process.
5. App Availability and Changes
We may update, modify, suspend, or discontinue the App (or any part of it) at any time without notice. We are not obligated to provide continued support, maintenance, or future updates.
6. Privacy
Your use of the App is subject to the Cardihaler App Privacy Policy, which explains how data is handled in connection with the App, including the use of Firebase for crash reporting and basic app performance monitoring. By using the App, you acknowledge that you have read and understood the Privacy Policy.
7. Intellectual Property
All rights, title, and interest in and to the App, including all intellectual property rights, are owned by or licensed to Conscious Breathing Institute AB.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for its intended purpose.
8. Disclaimer of Warranties
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, secure, or free of errors.
9. Limitation of Liability
To the fullest extent permitted by law, Conscious Breathing Institute AB shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App or any firmware updates performed using the App, including loss of data or device issues.
Nothing in these Terms limits liability that cannot be excluded under applicable law.
10. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. Upon termination, your right to use the App will immediately cease.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles.
12. Changes to These Terms
We may update these Terms from time to time. The “Effective Date” above indicates when the Terms were last updated. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.
